What a quitclaim deed does not solve
Do not assume a transfer removes a mortgage obligation, lien, inheritance dispute or boundary problem. Giving someone an interest in property and obtaining a lender's release from a loan are different matters. A closing professional needs to determine what you own and what a buyer can receive.

Which records should you bring?
- The current recorded deed and referenced prior instruments.
- Legal description, parcel information and any survey you have.
- Loan, lien and payoff records.
- Estate, trust, divorce or power-of-attorney documents relevant to authority.
- Any proposed deed, contract or request to change ownership.
A prior deed is evidence to examine, not a form to copy blindly. Names, legal descriptions and authority can need correction or explanation. Knox County recording is not a title guarantee
The Knox County Register's filing checklist includes preparer information, notarized seller signatures, owner and taxpayer details, value and consideration, a chain-of-title reference and a legal description. Confirm current submission requirements and fees with the office. Another county may have different administrative instructions.
Acceptance for recording does not establish that the transaction achieves your legal or tax goals. If an old recorded deed contains an error, do not alter that document yourself. Give the original and the suspected error to counsel to determine whether a corrective instrument or another legal step is appropriate.
Why the wording can affect recordation tax
UT County Technical Assistance Service explains that Tennessee's quitclaim tax treatment depends on the interest conveyed, not simply the document's title. Its guidance distinguishes tax classification from the validity of the underlying transfer. Do not add or remove clauses solely to obtain a lower tax result without qualified advice.
Ask for an explanation of the proposed tax basis, fees and any claimed exemption. A family relationship alone is not a substitute for confirming which rule applies.
